Investigators say Diaz and another suspect tried to rob a jewelry salesman on Friday afternoon outside the Hilton Garden Inn at the 3200 block of Sage Road.
TABC officer Michael Sehon, 40, was working an off-duty security job for the jewelry salesman and was inside a car as the two masked suspects approached.

Sehon was shot in the left leg above the knee and was taken to Memorial Hermann hospital but was later released.
Police say Sehon, a 5-year veteran of the TABC, was able to shoot at Diaz who was struck in the arms and back. The other suspect left him at Memorial Hermann Southwest Hospital to be treated for the injuries.training as regular police officers.
