Pasadena police officer facing deadly conduct charge

(5/11/07 - KTRK/PASADENA, TX) - A Pasadena police officer is under investigation, charged with deadly conduct.

The Pasadena Police Department says officer Marcus J. Kacz was off duty driving along Beltway 8 in Pasadena, when he says another driver became very aggressive. He chased the vehicle to a nearby apartment complex where he fought with a passenger.

The passenger got back in the car and drove off. Kacz then fired at the back of the vehicle.

"The decision was made at the district attorney's office that the circumstances in the officer's actions did not rise to the level of justification under the deadly force statutes," said Captain Bud Corbett with the Pasadena Police Department.

Kacz is suspended without pay while the investigation continues.
